GETTING A QUOTATION
What is needed?
To get quotations for After-the-Event Litigation Insurance, a Solicitor needs to complete ULP's Proposal Form with the Claimant client, provide certain other information requested and e-mail or post everything to ULP.
ULP’s Proposal Form is acceptable to most if not all of the Insurers currently operating in the ATE insurance market, therefore a Solicitor and Claimant only need to complete the one Proposal Form.
Is there a cost involved?
ULP charges a £100 Application Fee for each Proposal submitted. This will be the only fee a Solicitor/Claimant needs to pay, no matter how many Insurers ULP approaches.
If a Solicitor uses ULP’s services regularly, the application fee may be negotiable.
What will assist when seeking quotations?
Although Insurers obviously vary as regards their requirements, it is a fair generalisation to say that prospects of success need to be better than 50/50 and the longer the case has been running, the better the prospects need to be.
A comprehensively completed Proposal Form and helpful additional information, for example a succinct summary of the facts and issues, where the case has reached, what the defence is, expert opinions, evidence etc will improve the Claimant’s chances of obtaining a quotation from one or more Insurers.
A neatly and professionally constructed submission normally pays dividends.
Which types of cases are easy/difficult to get A-t-E cover for?
The easiest risks to insure tend to be personal injury cases, but Insurers will consider other types of claimant litigation such as personal or commercial contractual disputes, professional negligence actions, clinical negligence cases, insolvency actions, intellectual property disputes and even defamation.
